Our Commitment to CASL

Canada's Anti-Spam Legislation (CASL) is one of the strictest anti-spam laws in the world. We take our obligations under CASL seriously and are committed to sending only legitimate, consent-based commercial electronic messages.

This policy applies to all email, SMS, and other electronic communications sent by Chrootly Marketing Inc. to recipients in Canada or elsewhere.

Consent

Before sending commercial electronic messages, we obtain express or implied consent as required under CASL.

Express Consent

We obtain express consent through:

  • Contact form submissions on our website where users explicitly agree to receive communications
  • Signed service agreements with clients
  • Direct written or verbal confirmation

Implied Consent

Implied consent may apply in specific situations permitted under CASL, including:

  • Existing business relationships within the past 24 months
  • Existing non-business relationships within the past 2 years
  • Business contact information conspicuously published by the recipient

Message Requirements

Every commercial electronic message we send includes:

  • Clear identification of Chrootly Marketing Inc. as the sender
  • Our mailing address and a valid method of contact (email, phone, or website)
  • A functional, easy-to-find unsubscribe mechanism
  • Subject line that accurately reflects message content (no misleading subject lines)
  • Sender information that is accurate and not false or misleading

Unsubscribe Mechanism

Every marketing email we send includes an unsubscribe link. You can opt out at any time by:

  • Clicking the unsubscribe link at the bottom of any email we send
  • Emailing us at contact@chrootly.ca with "Unsubscribe" in the subject line
  • Contacting us by mail at our Toronto office

We process unsubscribe requests within 10 business days, as required by CASL. Once unsubscribed, you will not receive further commercial electronic messages unless you provide new consent.

Transactional Messages

CASL does not require consent for certain transactional or relationship messages, including:

  • Responses to requests for quotes or enquiries
  • Messages confirming a commercial transaction you initiated
  • Warranty, product recall, or safety information
  • Factual information about an ongoing service or subscription
  • Account-related notifications

These messages will continue to be sent as necessary to service our business relationship with you, even if you have unsubscribed from marketing communications.

Client Email Marketing Services

When Chrootly manages email marketing campaigns on behalf of clients, we ensure:

  • Client email lists are obtained with proper consent under CASL
  • All campaigns include compliant unsubscribe mechanisms
  • Sender identification complies with CASL requirements
  • Consent records are maintained and auditable
  • Clients understand their own CASL obligations as the message sender

Clients remain responsible for the content of messages sent and for obtaining and documenting consent from their recipients. We advise clients on CASL compliance but do not assume legal responsibility for client-initiated communications.

No Spam, Ever

We do not and will not:

  • Send unsolicited commercial messages to purchased or rented email lists
  • Use harvested or scraped email addresses
  • Hide or falsify sender information
  • Use misleading subject lines or content
  • Install software on your device without consent
  • Continue sending messages after you have unsubscribed

Reporting Violations

If you believe you have received an unwanted or non-compliant message from Chrootly Marketing Inc., please contact us at contact@chrootly.ca. We will investigate promptly and take corrective action.

You may also report CASL violations to the Canadian Radio-television and Telecommunications Commission (CRTC) through the Spam Reporting Centre.

We may update this Anti-Spam Policy to reflect changes in CASL, best practices, or our internal processes. Updates will be posted on this page with a revised "Last updated" date.
